Military Leave - Merit Date Grievance
August 22, 2005 - Recent developments have led us to believe that this particular grievance, after being addressed by the U.S. Department of Labor for their opinion on this subject, has come to a conclusion.
It was learned today that firefighter Steve "Doc" Roberts has been awarded by the Department of Labor (in its decision) all 'back-pay' (stretching back to March, 2004) which he was denied by the City of Norman after returning from active-duty serving in Iraq over a two-year period. The CON had determined, after reviewing conflicting documentation, that advancing Firefighter Roberts to his next scheduled step in the IAFF/CON pay-schedule was something the CON was NOT "required" to do. The CON further insisted that Firefighter Roberts' "merit-date" would be moved farther into the future to again hold back his "step-raise".
From what is known today, the CON has made these adjustments in accordance to the decision the U.S. Department of Labor decided best represents Federal guidelines with Firefighter Roberts' situation.
February 7, 2005 - The Union believes the contract language dealing with "military leave" is intended to mirror the minimum conditions that our members serving in the Military should be granted upon returning from active service in accordance with Federal Law.
